This is the Privacy Policy of RTA Media Holdings, LLC (hereafter referred to as “us” or “we”). This Privacy Policy describes what personal information is collected from website users (“you”) and how your personal information is collected, used, and shared when you use our streaming service through our website or any of our branded apps including “racingamerica.tv” and any successor or subdomain thereof and related domains or any other website where we post this Privacy Policy (together, the “Service”).
This Privacy Policy applies to any information we collect through our Service, including any information in any electronic messages between you and our Service, and any information about you transferred to our Service from other websites or applications. This Privacy Policy also applies to any information we collect about you when you mail us or e-mail, text or exchange other electronic messages with us or when you interact with messages you receive from us, and any information we collect about you offline that will be processed by automated means using our Service, such as any information we collect through paper forms or other manual submissions. This Privacy Policy does not apply to any other information we collect by any other means.
Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, you can choose not to use our Service or provide us with your information. By accessing or using our Service, you agree to this Privacy Policy. This Privacy Policy may change from time to time. When we make changes to this Privacy Policy, we will post the updated Privacy Policy on our Service and update the Privacy Policy’s “Last Modified” date. Your continued use of the Service after we make changes is deemed to be acceptance of those changes.
1. Personal Information We Collect
When you use our Service, we and third-party service providers acting on our behalf may collect the following types of information by which you may be personally identified or information about you that is maintained in personally identifiable form (collectively, “Personal Information”):
Account Registration Information: To sign up for a subscription or make a purchase, you must create an account by providing us with your full name, email address and creating a password. You may also provide us with your telephone number and mailing address. You may also create a username and upload an avatar to use for comments or forums and to access certain content.
Payment Information: You must also provide valid payment card information if you wish to sign up for a free trial, subscription, or make any other purchase. Except for the name associated with your card and information about the transaction (e.g., time of transaction, amount), payment card information is collected directly by a third-party payment vendor and is not received or stored by us.
Internet Activity: As you navigate through and interact with our Service or interact with the e-mails and other electronic messages we send to you, we or our third-party service providers may automatically collect information related to Internet or other similar network activity, including history, title, owners or other identifying information of the videos or content you view, browsing history, referring/exit pages, search history and information on your interaction with our Service or on your interaction with advertisements on our Service or other websites or applications and related metadata (“Internet Activity”) and certain traffic data, usage information, and information about your computer equipment or mobile device, such as your browser and operating system, IP address or mobile device ID, your internet service provider, your wireless carrier, your location, the geographic region from which you are accessing the Service, time-stamped logs regarding access times and duration of visits, the pages and components of our Service that you visit, whether you opened the e-mail message we sent to you and whether you clicked on any links in the message, configuration data, clickstream analytics and your actions and patterns when you use our Service or interact with our e-mail messages and related metadata (collectively, “Technical Information”). The technologies we use for this automatic data collection may include cookies that are stored on the browser of your computer or mobile device, small embedded electronic files known as web beacons (also referred to as clear gifs, pixel tags and single-pixel gifs) and other types of embedded code. We collect this information to manage our content and improve users’ use of our Service; to count and review the number of users of our Service and their usage patterns; to track key performance indicators such as pages accessed, frequency of access, conversions (the number of users who click on our advertisements and then go on to make a product or service purchase) and other statistical information related to our Service and the performance of our e-mail messages (for example, recording the popularity of certain content and verifying system and server integrity); to identify the portion of users who access our Service via different web browsers or mobile operating systems; to recognize if a user is a return user of our Service; to store information about a user’s visits; to remember a user’s preferences; and for similar purposes in connection with monitoring, operating, maintaining and improving our Service. Third parties may also collect Technical Information, Internet Activity and other information on our behalf as further described in the sections below titled “Use of Google Analytics,” “Use of Meta Business Tools,” “Use of Personal Information for Marketing Purposes,” and “Tracking and ‘DO NOT TRACK’.”
Comments: We may offer the ability to comment on a video or post in a forum. Any posts you make will be publicly available.
Other Information: You may also choose to provide other information about yourself in connection with surveys, contests, special offers, customer support inquiries, and other communications with us.
2. How We Collect Information
We primarily collect Personal Information directly from you as you provide it or submit it to us, either electronically or by paper form or other manual submission, including in connection with using the Service, registering to access and use the Service, completing a purchase through our Service, signing up to obtain information from us (such as by signing up to receive our periodic e-mails, e-newsletters or other marketing and promotional information about us or our products and services), entering into a sweepstakes, contest, giveaway or other promotion related to our products or services, responding to a voluntary survey you have agreed to complete, contacting us for service inquiries or reporting a problem with the Service, submitting an inquiry to us using the contact methods provided on our Service, or otherwise contacting us about our Service or our business. We and third-party service providers acting on our behalf may also collect your Technical Information and Internet Activity automatically as you navigate through or interact with our Service (see section above titled “Traffic, Usage and Computer/Device Information”).
In addition to collecting Personal Information directly from you, we may also receive Personal Information from third-party data brokers, resellers, advertising networks, data analytics providers and similar service providers from whom we purchase or license certain data to assist us in our business operations, including customer outreach or other customer relationship management efforts.
3. How We Use Your Information
A. Generally
We may use the information we collect about you or that you provide to us, including Personal Information, to:
Provide our Service and its contents to you (including by transmitting your Personal Information to a third-party vendor or integrated service like Vimeo, Google/Android, Apple TV, Amazon Fire, Samsung, and Roku to provide services and content to you and assist us with providing the Service to you on our behalf).
- Provide you with information, products or services you request from us and otherwise communicate with you. We will also maintain subscription, e-mails and mailing lists (such as lists to receive newsletters or alerts). In addition, we may send the following types of e-mails:
Transactional Emails: When you first subscribe, we may send you a welcome email that provides information about your subscription and your account. If you make a purchase, we may send you an email confirming your purchase. We may also send you other emails concerning your account status, subscription, and renewals. You may not opt out of transactional emails.
Marketing Emails: Depending on your preferences, we may send you emails letting you know about new programs or features, or promotions. You may opt out of these emails at any time using the link at the bottom of each email.
Process purchases you have made through our Service, including by transmitting your Personal Information to the third-party payment processor that we or our third-party service providers use for securely processing payment card purchases.
Authenticate or otherwise verify your identity in connection with your requests and inquiries via the Service or otherwise.
Provide you with support and respond to your inquiries and support requests relating to our Service, including to investigate and address your concerns and to monitor and improve our responses.
Carry out the advertising, promotional and marketing purposes as described in the section below titled “Use of Personal Information for Marketing Purposes.”
Help maintain the safety, security and integrity of our Service, databases and other technology assets and our business.

B. Use of Personal Information for Marketing Purposes
We and third-party service providers acting on our behalf may use your information (including Personal Information) for advertising, promotional and other marketing purposes in various ways. This includes:
Providing you with informational and promotional content and materials regarding the Service and our own products and services, such as advertising and promotional information about our products and services or information about special offers or promotions related to our products and services.
Providing you with informational and promotional content and materials regarding the products and services of affiliates or third party partners that we believe may be of interest to you.
Personalizing your Service experience and delivering content and promotional information related to your interests, including by delivering personalized e-mail content to you or by displaying targeted offers and ads to you on our Service and third-party sites that you visit and on which we place (or our third-party service providers place on our behalf) such ads.
Using third-party tools, such as Google Analytics (see section below titled “Use of Google Analytics”) and Meta Business Tools (see section below titled “Use of Meta Business Tools”), Roku Analytics (see https://docs.roku.com/published/userprivacypolicy/en/us), Apple TV Analytics (https://www.apple.com/legal/privacy/en-ww/), Amazon Fire Analytics (https://www.amazon.com/adprefs), to advertise to third parties with similar interests, hobbies or demographic information as you. This is not an exhaustive list of the third-party tools that we may use and we may not use any or all of these third-party tools during any given time.

C. Tracking and “DO NOT TRACK”
Tracking involves the use of cookies, web beacons or other embedded code or tracking technologies to collect, analyze and store information on a user’s behavior over time on multiple sites, including information on the sites visited, products viewed, products purchased and other online interactions. Tracking information allows us to make interest-based (behavioral) advertising available to you on the Service that you visit and use.
We and third-party service providers on our behalf may collect Personal Information about your online activities over time and across third-party sites for tracking purposes when you use our Service. Any third party program or service provider may have their own privacy policy which you should review in connection with your use of such program or feature which may be related to the Services.
Our Service does not respond to any “do not track” signals sent by your computer, browser or mobile device, and if your computer, browser or mobile device sends a “do not track” signal to our Service, our Service will not treat you differently from users who do not send such signals. D. Use of Google Analytics
We may use Google Analytics to track and analyze certain traffic and usage statistics regarding the use of our Service, such as the number of visitors to our Service, how visitors are navigating to our Service, visitors’ general geographic region and other location information, how long individuals are visiting our Service, and information about the equipment individuals are using to access our Service (e.g., browser version and operating system). Google Analytics may use a Google Analytics cookie as part of this service, and we may share certain Personal Information with Google Analytics as part of this service. We use this traffic and usage information to gauge, internally, the effectiveness of our advertising efforts and to make improvements to our Service and our marketing and promotional efforts.

By enabling these features, we and certain third-party vendors use first-party cookies (such as the Google Analytics cookie) or other first-party identifiers, and third-party cookies (such as Google advertising cookies) or other third-party identifiers together for various purposes. The information collected includes demographic information about our Service visitors and general information about our visitors’ interests. We use the information collected through our use of the Google Analytics Advertising Features to track our Service visitors’ patterns and behaviors, segment our audience, and to better target our advertising and marketing efforts (for our own and others’ products and services) and allow third-party vendors to do the same, for example to (1) display targeted advertisements to individuals who viewed a product or service but did not purchase the product or service, (2) target visitors from a certain geographic region with certain ads in Google search results that have previously shown a high degree of success for consumers in that region, (3) advertise our products and services across other websites and applications that you may visit, or (4) allow Google or other third-party vendors to show you ads on websites and applications that you visit after using our Service or clicking on an offer or ad in one of our e-mails or in our Service.

Because those opt-out and preference control pages are specific to the individual browser used to visit it, and because those pages are not operated by us, we are unable to perform the opt-outs on your behalf.
E. Use of Meta Business Tools
We may use various advertising services and business tools provided by Meta (operator of the Facebook website) in connection with our Service. The services and tools we may use are summarized on Meta’s website here: https://www.facebook.com/legal/terms/businesstools. In connection with our use of these services and tools, Meta may use cookies, pixels, web beacons and other storage technologies to collect or receive information from the Service and elsewhere on the Internet and use that information to provide measurement services and target ads to you and others. Those technologies may include, but are not limited to, Meta Pixel, Conversions API, App Events via Facebook SDK, Offline Conversions and App Events API. In connection with this service we may provide your e-mail address to Meta along with the e-mail addresses of our other users, and Meta may use this information to find other users of its Facebook platform with similar demographics and interests as indicated in the profiles and activities on Facebook of our users generally, to help us better target our advertising efforts on Facebook to those other Facebook users. You can opt out of certain Meta advertising features by visiting the Network Advertising Initiative’s Consumer Opt-Out page at https://thenai.org/opt-out/ and the Digital Advertising Alliance’s Consumer Assistance page at https://youradchoices.com/control or by adjusting the privacy settings in your Facebook profile. Because those opt-outs, preference control pages and privacy settings are specific to the individual browser used to visit it or the individual Facebook profile, and because those opt-outs, preference control pages and privacy settings are not operated or controlled by us, we are unable to perform the opt-outs, set your preferences or adjust the privacy settings on your behalf.
4. Disclosures to Third Parties
We may disclose your information to the following types of third parties:
Authorized Service Providers: We share your information with authorized service providers involved in operating the Service or such authorized service providers may collect Personal Information directly from you on our behalf while you use our Services to provide the Services to you or otherwise involved in the hosting, maintenance, operation and promotion of our Services and permitted uses of Personal Information under this Privacy Policy. Our authorized service providers may include vendors to provide the Service and power the Service or provide customer support like Vimeo OTT, Roku TV, Apple TV, and Amazon Fire; payment providers; customer relationship management and email service providers; cloud hosting; and analytics and digital marketing companies. We may disclose Personal Information to (or permit Personal Information to be collected on our Services by) certain third parties as described in the section above titled “How We Use Your Information.”
Legal Situations: We may disclose your information when we have a good faith belief that compliance is required by a search warrant, subpoena, court order, or similar request from a law enforcement or other government agency.
Sale Transaction: We may disclose Personal Information to our affiliates or to a buyer or other successor to our business in the event of a sale of equity or assets, reorganization, merger, divestiture or a similar corporate transaction, whether as a going concern or as part of a bankruptcy, liquidation or similar proceeding, and any due diligence review with respect to any such proposed transaction.
Legal Agreements: We may disclose Personal Information to enforce or apply any legal agreements between us and you, or if we believe disclosure is necessary or appropriate to protect the rights, property or safety of our users or others.
To the Public: We may publicly disclose aggregated user statistics and other information, which is not considered Personal Information. If you comment on a video or participate in a forum, your comment may be shared publicly.
We may also disclose all forms of Personal Information for each of the purposes above, for any purpose disclosed when the information is provided, and for any other purpose with your consent. To understand how third parties may disclose your information, you should consult their privacy policies.
5. Third-Party Sites and Services
Our Service and e-mail messages to you may include links to blogs, social media, and third-party platforms, services, features, and websites (“third-party sites”). These third-party sites have their own privacy policies and terms of use and are not controlled by this Privacy Policy. You should carefully review any terms, conditions and policies of such third-party sites before visiting them or supplying them with any Personal Information. If you follow a link from our Service or e-mail messages to any third-party site, any information you provide to that site will be governed by its own terms of use and privacy policy and not this Privacy Policy.
We are not responsible for the privacy or security of any information you provide to a third-party website or the information practices used by any third-party site, including those that are accessed via links from our Service or e-mail messages. We make no representations, express or implied, concerning the accuracy, privacy, safety, security or the information practices of any third-party site. The inclusion of a link to a third-party site on our Service or in our e-mail messages does not constitute any type of endorsement of the linked site by us. We are not responsible for any loss or damage you may sustain resulting from your use of any third-party website or any information you share with a third-party website.
6. Your Privacy Rights
A. Generally
- If required by applicable law, residents of certain jurisdictions may have the following rights:
The right to access, correct, delete, restrict or object to our use of your personal information, the right to request information about the categories and sources of personal information collected about you, and the associated purposes for collection and third-party disclosures; and/or the right to opt out of the sale of your personal information. This includes certain preferences like the sharing of viewing information together with certain personal information.
If you would like to exercise any of these rights, please submit your request at Legal Notices or support@racingamerica.com. Please also check our Cookie Policy as well as your preferences and settings in your account and browser/device.
Account: You may change your account information or close your account at any time by logging into your account and adjusting your account settings. If you cancel your subscription, close your account, or request that we delete your account, you may lose access to content you have purchased. When you cancel your subscription or close your account or request deletion of Personal Information, we may preserve certain account information to (i) let you know about new offers and content; (ii) restore your account, if you ever wish to re-subscribe; and (iii) enforce our rights, where we believe in good faith that preservation is necessary to do so; (iv) comply with or avoid violating any law or legal requirement or cause the information to be incorrect.
Browser Settings: You have certain choices regarding the Personal Information you provide to us. You can set your browser to refuse or reject all or some cookies and/or adjust your permission settings. If you choose not to accept cookies or adjust your permission settings, you may be unable to access certain parts or pages of our Service, or certain parts or features of our Service may not function properly.
Email/Notifications: If you do not wish to have your Personal Information used by us to contact you with promotional or informational content or messages, you may send us an e-mail stating your request to support@racingamerica.com or you can opt out by simply clicking on the “Unsubscribe” or similar link in the most recent e-mail you received from us and by following the prompts that appear. This opt-out does not apply to information provided as a result of a product purchase, customer service or support service inquiry, or other informational or transactional communications, nor does it apply to your disclosure to a third party that is acting on our behalf and under our instructions in support of our permitted uses of your Personal Information.
Third-Parties: We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. Please refer to the sections above titled “Tracking and ‘DO NOT TRACK’”, “Use of Google Analytics”, and “Use of Meta Business Tools” for more information regarding opting out of certain advertising and analytics features used on and in connection with our Service.
B. Users Outside of the United States
Our Service is hosted in the United States and is provided from the United States. It is possible that certain information will be stored on servers in multiple other countries on the “cloud” or other similar distributed hosting platforms. If you are accessing our Service from Canada, the UK, European Union, Asia or any other jurisdiction with laws governing personal data collection, use and disclosure that differ from United States laws, please note that by using our Service and providing your Personal Information to us through our Service you are expressly and knowingly consenting to the transfer of your Personal Information from your home country to the United States and other jurisdictions as indicated above (where laws may differ from the laws of your jurisdiction) and you are expressly and knowingly consenting to our use of such Personal Information in accordance with this Privacy Policy.
C. California “Shine The Light” Disclosure
The California Civil Code permits California residents with whom we have an established business relationship to request that we provide a list of certain categories of Personal Information that we have disclosed to third parties for their direct marketing purposes during the preceding calendar year. To make such a request, please send an e-mail to Legal Notices or support@racingamerica.com. Please mention that you are making a “California Shine the Light” inquiry. At this time, we do not engage in this type of disclosure.
D. California Residents
Users from California may have the right to: request information about the categories and sources of personal information collected about you, and the associated purposes for collection and third-party disclosures; request a copy of your personal information; request deletion of your personal information; and opt out of the sale of your personal information.
If applicable, to exercise your right to access or delete your personal information, submit your request by using our form. Note that to process your request, we must be able to verify your identity as the owner of the account you are inquiring about. We may not be able to fulfill your request until we can do so. Although you do not need to have an account to submit a request, we may not be able to locate certain information to process your request if you don’t have one.
E. Nevada Residents
Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request to this designated address: Legal Notices or support@racingamerica.com. Please mention that you are making a “Nevada Sale Opt-Out Right” request. However, please know that we do not currently sell data triggering that statute’s opt-out requirements.
F. Children’s Privacy
The Service is not intended for individuals under the age of 16, or the applicable age of majority in your jurisdiction, whichever is greater. If you are a parent or legal guardian who has discovered that your child has provided personal information through the Service without your consent, please contact us so that we can remove any unauthorized information.
7. Data Security
We work hard to protect the confidentiality and security of information we obtain in the course of business. We use commercially reasonable safeguards, such as industry-standard encryption technology, to help keep the information collected through the Service. Despite efforts to store Personal Information in a secure operating environment, we cannot guarantee the security of Personal Information during its transmission or its storage on our systems. We also cannot guarantee that our security measures will prevent third parties such as hackers from illegally obtaining access to Personal Information. We do not represent or warrant that Personal Information about you will be protected against, loss, misuse, or alteration by third parties. You should take care to protect any user logins and passwords and be aware of the risks of transmitting information over the internet, by email, in blogs or chats, or when using online sites.
8. Changes
We may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons. Your continued use of the Service constitutes your agreement to any updated Privacy Policy on a prospective basis.
